Pay attention! Before March 15th! Key Guidelines for Enterprises to Disclose environmental Information in accordance with the law

I. Subject of Disclosure:

(1) major pollutant-discharging units;

(2) Enterprises conducting mandatory cleaner production audit;

(3) Listed companies and bond issuing enterprises with relevant illegal acts)

Ii. Contents Disclosed in the Annual Report:

(1) Basic information of the enterprise, including basic information on production and ecological and environmental protection of the enterprise;

(2) Environmental management information of enterprises, including information on ecological and environmental administrative license, environmental protection tax, environmental pollution liability insurance, environmental protection credit evaluation, etc.;

(3) Information on the production, treatment and discharge of pollutants, including pollution prevention and control facilities, discharge of pollutants, discharge of toxic and harmful substances, production, storage, flow direction, utilization, disposal and self-monitoring of industrial solid waste and hazardous waste;

(4) carbon emission information, including information on the amount of carbon emission and the facilities for discharging it;

(5) ecological environment emergency information, including emergency plans for environmental emergencies and emergency responses to heavy pollution weather;

(6) illegal information on ecological environment;

(7) Disclosure of provisional environmental information of the current year according to law;

(8) Other environmental information as stipulated by laws and regulations.

3. Cleaner production enterprises shall also disclose the following information:

(1) Reasons for the implementation of mandatory cleaner production audit;

(2) Implementation, evaluation and acceptance of mandatory cleaner production audit.

Iv. Listed companies and bond issuers shall also disclose relevant information:

(1) Where the listed company conducts financing through the issuance of stocks, bonds, depositary receipts, medium-term notes, short-term financing bonds, ultra-short-term financing bonds, assets securitization, bank loans, etc., it shall disclose the annual financing form, amount, investment and other information, as well as the relevant information on the response to climate change, ecological and environmental protection of the financing projects;

(2) In case of financing by issuing stocks, bonds, depositary receipts, exchangable bonds, medium-term notes, short-term financing bonds, ultra-short-term financing bonds, asset securitization, bank loans, etc., the bond issuing enterprise shall disclose the annual financing form, amount, investment direction and other information, as well as the relevant information on the response to climate change and ecological and environmental protection of the financing projects.

V. Contents of Temporary Environmental Information Disclosure:

(1) Information on the granting, alteration, extension and cancellation of the administrative license for ecological environment;

(2) Information on administrative penalties imposed for ecological and environmental violations; (3) Information on administrative detention imposed on its legal representative, main responsible persons, persons directly in charge and other persons directly responsible for ecological and environmental violations;

(4) Information on the criminal responsibility of the enterprise or its legal representative, main responsible persons, persons in charge directly responsible and other persons directly responsible for the ecological and environmental violations;

(5) Information on compensation for ecological and environmental damage and agreements.

Where an enterprise encounters an environmental emergency, it shall disclose relevant information in accordance with relevant laws and regulations.

Vi. Time Limit for publishing annual environmental information of Enterprises:

Enterprises shall disclose the environmental information from January 1 to December 31 of the previous year before March 15 of each year.

Vii. Enterprise Environmental Information Disclosure Platform:

The Ministry of Ecology and Environment and the local ecological environment administrative departments at or above districted cities shall establish a legal disclosure system for enterprise environmental information by relying on government websites.

Viii. Legal Liability

(1) Where an enterprise fails to disclose environmental information, or the environmental information disclosed is untrue and inaccurate, the competent department of ecological environment at or above the districted city shall order it to make corrections, circulate a notice of criticism, and may impose a fine of not less than 10,000 yuan but not more than 100,000 yuan.

(2) The enterprise has the following circumstances

(1) The disclosure of environmental information does not meet the requirements of the Code;

(2) Disclosing environmental information beyond the prescribed time limit;

(3) Failing to upload environmental information into the legal disclosure system of enterprise environmental information.

The administrative department for ecological environment at or above the districted city level shall order it to make corrections, circulate a notice of criticism, and may impose a fine of not more than 50,000 yuan.
